Poze Terms of Usage

Welcome to Poze! These Terms of Usage (“Terms”) form a legally binding contract between you and Humpty Dumpty Studio (“we,” “us,” or “our”) concerning your download, installation, and use of the Poze iOS mobile application (the “App”).

By downloading, installing, accessing, or using Poze, you explicitly agree to be bound by these Terms. If you do not agree to these Terms in their entirety, you do not have permission to use the App and must delete it from your device immediately.

1. Eligibility & Dating Platform Rules

  • Minimum Age: You must be at least 18 years old (or the legal age of majority in your jurisdiction, whichever is higher) to use Poze. This App is strictly designed to optimize photos for dating platforms, which themselves require users to be adults.
  • Compliance with Third-Party Platforms: Poze helps you enhance photos for use on third-party dating apps and websites (e.g., Tinder, Bumble, Hinge). You acknowledge that you are solely responsible for ensuring that any image generated by Poze complies with the terms of service, photo verification guidelines, and community standards of those respective platforms.

2. Description of Service

Poze is an iOS application that leverages artificial intelligence models (via third-party endpoints like fal.ai) to process, style, and enhance reference photographs uploaded by you. The service is intended for personal, non-commercial entertainment and profile-optimization purposes. We reserve the right to modify, suspend, or discontinue any feature, tool, or part of the App at any time without prior notice or liability.

3. Subscriptions, Purchases, and Credits

Poze may offer certain features, AI generations, or premium styles on a paid basis, either via one-time credit purchases or recurring subscriptions (“Paid Services”).

  • In-App Billing: All purchases are processed securely through Apple’s StoreKit framework. Your payment relationship is directly with Apple Inc. Any billing inquiries, refund requests, or subscription cancellations must be managed directly through your iOS Apple ID Account Settings.
  • Subscripton Renewal: Subscriptions automatically renew at the end of each billing cycle unless canceled at least 24 hours before the renewal date.
  • No Refunds by Us: Humpty Dumpty Studio does not directly process payments and cannot issue refunds. All credit token packages or subscription balances have no monetary cash value, are non-transferable, and are non-refundable.

4. Intellectual Property & License Grants

4.1. Our License to You

Subject to your strict compliance with these Terms, Humpty Dumpty Studio grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to download and use Poze on a compatible iOS device for your personal, non-commercial use.

4.2. Ownership of the App

Except for your User Content (defined below), all right, title, and interest in and to the App—including its source code, user interfaces, design, branding, logos, graphics, and underlying AI prompt frameworks—belong exclusively to Humpty Dumpty Studio. You may not copy, reverse-engineer, decompile, or attempt to extract the source code of the App.

4.3. Your User Content & AI Outputs

  • Your Inputs: You retain all ownership rights to the original reference photograph you upload to the App (“User Content”). You grant us a temporary, automated, and strictly technical license to process your photograph through our third-party AI provider (fal.ai) solely to deliver the edited output image to your device. As detailed in our Privacy Policy, this data is processed ephemerally and is not saved on our servers.
  • The AI Outputs: To the maximum extent permitted by applicable law, you own the resulting edited/stylized image generated by the App (“Output”). Humpty Dumpty Studio claims no ownership rights over your generated images.

5. Acceptable Use Policy & Restrictions

To maintain safety and platform integrity, you agree never to use Poze to:

  • Catfishing & Deception: Create synthetic imagery or deepfakes intended to maliciously misrepresent your true physical identity, or deliberately deceive or defraud other users on dating platforms.
  • Infringement of Rights: Upload or process a reference photograph of any other individual without their explicit, documented consent.
  • Minors: Upload, process, generate, or share any image depicting a minor under the age of 18 in any context whatsoever.
  • Harmful Content: Generate content that is obscene, pornographic, violent, defamatory, harassing, hateful, racially offensive, or otherwise unlawful.
  • Technical Abuse: Attempt to bypass our usage limits, scrape our API endpoints, flood the AI processing infrastructure, or inject malicious code into the App.

Violation of this section constitutes a material breach of these Terms and will result in the immediate termination of your access to the App without a refund.

6. Disclaimer of Warranties (The “As-Is” Clause)

Please Read Carefully: Poze is provided to you on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind.

To the maximum extent permitted by law, Humpty Dumpty Studio explicitly disclaims all warranties, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that:

  1. The App will meet your specific aesthetic requirements.
  2. The App will operate completely error-free or uninterrupted.
  3. The generated outputs will pass automated or manual photo verification checks on third-party dating apps.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Humpty Dumpty Studio, its directors, employees, or partners, shall not be liable for any indirect, incidental, special, consequential, or punitive damages. This includes, without limitation, loss of profits, data, use, goodwill, or other intangible losses resulting from:

  • Your use of or inability to use the App.
  • Any unexpected behavior, generation errors, or service downtime caused by third-party AI endpoint infrastructure (e.g., fal.ai).
  • Any account suspensions, bans, or negative outcomes you experience on third-party dating platforms or social media networks due to uploading images modified by Poze.

In no event shall our total aggregate liability for all claims relating to the App exceed the total amount paid by you to us for using the App in the twelve (12) months preceding the event giving rise to liability.

8. Termination

We reserve the right, in our sole discretion and without liability or prior notice, to terminate or suspend your license to use the App, or block your device’s access to the generation APIs, if we believe you have violated these Terms, engaged in fraudulent activity, or posed a safety risk to others. You may terminate these Terms at any time simply by deleting the App from your device and canceling any active subscriptions via Apple StoreKit.

9. Governing Law & Dispute Resolution

These Terms and any dispute arising out of your use of Poze shall be governed by and construed in accordance with the laws of Bangladesh, without regard to its conflict of law principles. Any legal action, suit, or proceeding arising under these Terms shall be brought exclusively in the courts located in Dhaka, Bangladesh, and you hereby consent to the personal jurisdiction of such courts.

10. Severability & Entire Agreement

If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect. These Terms constitute the entire agreement between you and Humpty Dumpty Studio regarding the App.

11. Changes to the Terms

We may update these Terms from time to time. When we make changes, we will revise the “Last Updated” date at the top of this document. If a change is material, we will provide a prominent notice within the App upon its next launch. Your continued use of Poze following the posting of updated Terms means that you accept and agree to the changes.
